THE HABEAS CORPUS CASE OF DR. A. E. PETICOLAS. - Judge Meredith, on yesterday morning, delivered his decision in the case of Dr. A. E. Peticolas, brought before him on a writ of habeas corpus, praying to be delivered from the custody of the Henrico Justices, who committed him for contempt in declining to testify in the matter of the Daniel Elmore duel, on the ground that by so doing he might commit himself. The learned Judge decided that Dr. Peticolas was not bound to testify, and discharged him from the custody of the Justices. The Judge said he would not pronounce upon the constitutionality of the act of Assembly of 1860; but he did not consider that law in conflict with the previous law on dueling.

Mr. J. B. Young, Commonwealth's Attorney took an appeal from the judgment of the Court.
